Advocacy & Legislative Priorities

The Brewers of Pennsylvania (BOP) actively advocates for policies that strengthen Pennsylvania’s brewing industry, support brewery growth, and create a more competitive and sustainable business environment for independent breweries across the Commonwealth. Working alongside industry partners, legislators, and stakeholders, BOP is engaged in several important legislative initiatives that directly impact Pennsylvania breweries.

Current Legislative Priorities

HB 2340 – Brewery Tax Credit Improvements

Sponsored by Rep. Jose Giral Tiburcio

HB 2340 would improve and modernize Pennsylvania’s existing brewery tax credit program by making brewery tax credits saleable and extending the timeframe breweries have to utilize those credits from three years to five years.

These changes would provide breweries with greater financial flexibility and increase the overall value and usability of the program, particularly for growing breweries and those making major capital investments. By allowing credits to be sold and extending the redemption window, the legislation helps breweries better manage cash flow while continuing to invest in equipment, facilities, jobs, and expansion opportunities.

BOP strongly supports HB 2340 as a meaningful step toward improving Pennsylvania’s business climate for breweries and helping breweries of all sizes continue to grow and compete.

HB 2234 – Brews to Barns Act

Known as the “Brews to Barns” bill, HB 2234 would provide breweries with a deduction on their state excise tax for donating spent grain to local farms.

Spent grain is a natural byproduct of the brewing process and is commonly reused as livestock feed by Pennsylvania farmers. This legislation encourages sustainable practices, reduces waste, supports local agriculture, and strengthens the relationship between breweries and farming communities throughout the Commonwealth.

The legislation recognizes the environmental and agricultural benefits breweries already provide and rewards brewers for contributing to Pennsylvania’s agricultural economy.

HB 1041 – Brewery & Distillery Equipment Modernization

Sponsored by Reps. Fritz and Malagari

HB 1041 would allow breweries that also obtain a distilling license to use their existing brewing equipment within the same licensed area to produce distilled products.

Under current Pennsylvania law, breweries and distilleries must maintain completely separate licensed spaces and equipment, even though federal law already permits shared use of brewing and distilling equipment. This legislation would bring Pennsylvania law into parity with federal regulations while reducing unnecessary operational and financial burdens on breweries seeking to diversify their product offerings.

The bill supports innovation, operational efficiency, and small business growth by removing outdated regulatory barriers.

HB 885 – Expanded Brewery Storage Rights

Sponsored by Rep. Mustello

HB 885 would create greater parity across Pennsylvania’s alcohol industry by increasing the number of permitted brewery storage locations from two to five.

Wine and spirits manufacturers in Pennsylvania are already permitted up to five storage locations, while breweries are currently limited to two. This legislation would establish more equitable treatment across manufacturing license types and provide breweries with additional logistical flexibility to support production, distribution, and growth.

Expanded storage rights would help breweries better manage inventory, improve distribution efficiency, and support continued expansion throughout Pennsylvania and neighboring markets.
